“Appeals” confirms death penalty for Ubayyid massacre perpetrators

Today, Monday, the court issued its ruling in the appeal submitted regarding the death sentence issued in the “al-Ubayyid Massacre” case.

The appeals court in North Kordofan state, central Sudan, upheld the conviction verdict issued against 6 defendants in what is known as the al-Ubayyid massacre, which was committed by a number of Rapid Support Forces militia men.

In August of last year, the al-Ubayyid city court sentenced the six defendants to death for the killing of school students in the city.

The first defendant was referred to the Children’s Court in al-Ubayyid for not having reached the legal age when he committed the crime, while two other defendants were acquitted.

Today, Monday, the court issued its ruling in the appeal submitted to it regarding the death sentence issued in the communication.

The verdict stated its “confirmation of the conviction of 6 of the accused under Articles 21/130 of the 1991 Criminal Code.”

It also decreed the death by hanging sentence as retribution, and supported the conviction of the accused, Muhammad Ahmed Abdullah Huna – the minor – known as (Al-Shibli) under Articles 21/130 of the 1991 Criminal Code.

The court annulled the trial court’s to have him referred to the Children’s Court.

This ruling indicates that the convict, Mohamed Ahmed Abdullah Huna (Al-Shibli) was not a child at the time of the crime on July 29, 2019, and that he was over the age of eighteen and therefore the Sudanese Child Law of 2010 does not apply to him.

The Ubayyid Massacre

The events took place in July 2019 when 5 demonstrators, including 4 students, were killed during protests rejecting the findings of an investigation committee headed by former Attorney General Al-Waleed Sayed Ahmed, regarding the dispersal of the sit-in at the Army General Command in the capital, Khartoum.

A military vehicle stationed in the main market opened fire at the peaceful protest marches.

In July 2020, the trial sessions of the accused began in al-Ubayyid last August, convicting all 6 defendants under Article 130 of the Criminal Code related to premeditated murder.
